Mr. Phelan joined the firm in 2019 and is a member of the firm’s Litigation Practice Group.

Mr. Phelan regularly represents clients in complex and high-risk matters.  His litigation practice is focused on commercial real estate disputes, including those involving joint venture partners and the enforcement of mortgage or mezzanine loans.  Notwithstanding his excellent track record in court, Mr. Phelan is adept at finding practical resolutions to avoid litigation to begin with.

During his initial year with the firm, Mr. Phelan gained experience as a real estate finance attorney, during which he assisted in the firm’s representation of institutional lenders in the origination of mortgage, mezzanine and Property Assessed Clean Energy (PACE) loans on a variety of real estate assets.  He is also experienced in representing charitable organizations, including both public charities and private foundations in various transactions.

Prior to joining the firm, Mr. Phelan was the first attorney in the United States to successfully focus a practice on diabetes law, and his work in Federal courts and administrative proceedings has changed the landscape for how people with Type 1 Diabetes are accommodated in schools and in the workplace.  Mr. Phelan’s matters have involved not only disability discrimination on behalf of individuals under the Americans with Disabilities Act and Section 504 of the Rehabilitation Act in United States District Court, but also a variety of antitrust and trade regulation issues on behalf of pharmaceutical and healthcare businesses. Mr. Phelan continues to maintain an active pro bono practice where he regularly assists members of the Type 1 Diabetes community.  Mr. Phelan has spoken extensively around the country on the rights of people with Type 1 Diabetes, and has been featured in multiple publications for his groundbreaking work in this area.

Mr. Phelan graduated from New York Law School and is admitted to practice only in New York.
